Website Terms and Conditions

J&M Community Services LLC

Effective date: 10/08/2026

1. Website scope and use

These Terms and Conditions govern use of https://www.jmcommunityservices.com/ (the “Website”), operated by J&M Community Services LLC (“J&M,” “we,” “us,” or “our”). The Website provides information about our day activity and Individual Skills and Socialization (ISS) services for adults with disabilities in Lubbock, Texas.

Please read these terms before using the Website. If you do not agree with them, discontinue Website use. Where a Website feature asks you to accept these terms, your affirmative acceptance applies to that feature. These terms do not create a service agreement or waive rights that cannot lawfully be waived.

2. Service information and eligibility

Our Website describes on-site and off-site services, Texas Medicaid waiver services, and private-pay options. References to Home and Community-based Services (HCS), Texas Home Living (TxHmL), and Deaf Blind with Multiple Disabilities (DBMD) describe potential program pathways; they do not establish an individual’s eligibility or guarantee funding, authorization, or placement.

Services depend on applicable program requirements, individual needs, service authorization, available capacity, and completion of the enrollment process. Contact us to confirm current availability and whether we can meet the individual’s support needs. Individual goals and outcomes vary; Website descriptions do not guarantee a particular result.

3. Enrollment and separate agreements

Browsing the Website, requesting information, submitting an inquiry, or arranging a tour does not enroll an individual, reserve a place, or authorize services. Services begin only after required arrangements, authorizations, and applicable agreements are completed.

Written enrollment documents, provider contracts, private-pay agreements, and approved service plans govern actual services, schedules, responsibilities, and charges. Those documents control over these Website terms regarding service delivery, subject to applicable law. Website terms do not amend an existing service agreement.

4. Rates payments and cancellations

Private-pay rates, payment deadlines, cancellation terms, and any refund provisions are established in the applicable written private-pay agreement. Website statements about private-pay options do not constitute a binding price quote.

Medicaid waiver billing is governed by applicable program rules, authorizations, and provider agreements. These terms do not make an individual or family responsible for Medicaid-covered charges or authorize additional fees. We will confirm applicable financial arrangements through the appropriate agreement before services begin.

5. General information and emergencies

Website content is general information about our services. It is not individualized medical, legal, financial, or benefits advice and does not replace professional evaluation or an individual’s service plan. Consult an appropriate professional or program representative about personal needs, eligibility, and treatment decisions.

The Website and general email inbox are not emergency services and should not be relied on for an immediate response. Call 911 for an emergency. Current participants and representatives should follow the communication procedures provided during enrollment for urgent service-related matters.

6. Inquiries and sensitive information

When contacting us, provide accurate information and submit information about another person only when you have appropriate authority. A family relationship alone does not necessarily authorize someone to consent, sign agreements, or access another person’s confidential records.

For an initial inquiry, limit your message to basic contact information and a general description of your request. Do not send Social Security numbers, Medicaid identification numbers, detailed medical records, financial account information, or other sensitive records through ordinary email or a general Website form. Contact us first to arrange an appropriate method of sharing records.

An inquiry permits us to respond to that request using the contact details you provide. It does not by itself authorize marketing messages, public use of your information, or disclosure of a participant’s confidential records.

7. Privacy and participant images

These terms do not replace a separate Website privacy policy or any privacy or confidentiality notices applicable to services. Collection and handling of personal information remain subject to applicable law and the relevant notices we provide.

Using the Website does not give J&M permission to publish a participant’s photograph, video, testimonial, or personal information. Any required permission for those uses must be obtained separately. You may not reuse images or identifying information of participants displayed on the Website without the required authorization.

8. Permitted and prohibited use

You may view the Website and print or save reasonable portions for personal use, evaluating services, or discussing services with an individual’s support team, while retaining ownership notices. Other uses require our permission or an applicable legal right.

You may not use the Website to commit fraud, impersonate another person, harass others, submit unlawful content, introduce malicious software, gain unauthorized access, interfere with Website operation, or collect personal information about participants or staff without authorization. Automated access that bypasses protections or materially disrupts the Website is prohibited. Nothing here restricts lawful reporting, protected speech, or legally permitted accessibility tools.

9. Ownership of Website content

Website text, branding, logos, graphics, and other materials are owned by J&M or used with permission, except where otherwise indicated. Website access does not transfer ownership or grant permission to use our name or logo to imply an endorsement or affiliation. Rights available under applicable law, including fair use, remain unaffected.

10. Third party websites

If the Website links to third-party websites or services, those providers control their own content, terms, and privacy practices. A link does not by itself constitute an endorsement. Review the third party’s information before providing personal information or relying on its content.

11. Website availability and liability

We aim to keep Website information accurate, but errors, outdated information, and interruptions may occur. Confirm important details directly with us. To the extent permitted by law, we do not warrant uninterrupted or error-free Website access.

To the extent permitted by law, J&M is not liable for indirect or consequential losses arising solely from Website use or inability to access it. This limitation concerns Website use only. It does not limit liability for actual care or services, personal injury, fraud, gross negligence, willful misconduct, unlawful disclosure of information, or any liability or remedy that applicable law does not allow us to limit.

12. Participant rights and concerns

Nothing in these terms reduces participant rights, changes required protections, excuses mandatory reporting, or prevents a person from making a complaint, reporting suspected abuse, neglect, or exploitation, contacting a regulator, or exercising rights under applicable law.

If you encounter an accessibility barrier or need Website information in another format, contact us using the details below. You may also contact us about Website errors or concerns. Contacting J&M first is not a condition of reporting a concern to an outside authority.

13. Changes governing law and severability

We may update these terms by posting a revised version with an updated effective date. Changes apply prospectively and do not retroactively change existing service agreements or previously accrued rights. Where affirmative acceptance is required by law or by a particular feature, we will obtain it separately.

Texas law and applicable federal law govern these terms. Nothing here requires arbitration, waives a jury trial or class action, restricts legally available complaint channels, or overrides mandatory jurisdiction or venue rules. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
